Why did the newly elected UHJ that now sits in Haifa consult with the Hands when there is no support in the Writings providing for the UHJ to consult with the Hands or gives them a position of authority over the Universal House of Justice? 36. How come, in the Will and Testament, it says that the "guardian of the Cause of God" is the "sacred head and the distinguished member for life of that body [the Universal House of Justice] but the UHJ now sitting in Haifa does not have a guardian or anyone else as its head and has no member for life? 37. Why is it, that, although the Will and Testament says that the guardian will have the power to expel a member of the Universal House of Justice from that body if the member should "commit a sin injurious to the common weal," the UHJ now sitting in Haifa does not have a guardian to perform this function, but instead the UHJ now performs this function for itself? 38. Why is it that, under the terms of the Will and Testament, the Huquq is to be offered through the Guardian, yet the UHJ now sitting in Haifa demands and accepts the Huquq instead? 39. How could the UHJ now sitting in Haifa review the Guardian's appointment of his successor and decide whether it would accept Shoghi Effendi's appointment when the Will and Testament of 'Abdul-Baha does not give the Universal House of Justice the power to countermand the Guardian's appointment of his successor, or even to investigate the processes by which the Guardian chooses his successor? 40. How can the UHJ function without a guardian to provide authorized interpretation's of Bahá'í Writings in light of the statement by Shoghi Effendi that, while he guardian "cannot override the decision of the majority of his fellow-members, [he] is bound to insist upon a reconsideration by them of any enactment he conscientiously believes to conflict with the meaning and to depart from the spirit of Baha'u'llah's revealed utterances." 41. If there is no living Guardian of the Faith to provide direction, how does one interpret Shoghi Effendi's statement that the Guardian provides "the necessary guidance to define the sphere of the legislative action of its [the UHJ's] elected representatives"? to be continued...
