 The constitution is supposed to guarantee "No cruel and unusual
punishment".

 And what if some laws are unjust, and there are more and more of
them. People
can be thrown in prison for just about anything these days.

 I don't know about number #1, scince the gov't has no business in
telling
people what they can and cannot smoke. Cannabis should've been
regulated like
alcohol (which, oddly causes people to become violent, unlike
cannabis)
and kept in  a legal market. Infact up until about a century ago, you
could buy pot at a pharmacy, and hemp was used to create ropes and
fabrics. This
competed with other corperation's products at the time, so they used 
politicans to spread racist propaganda about hemp/cannabis (pulling
the
wool over the sheeple's eyes), thus successfuly getting it banned and
eliminating their competition.

 As for #2, bad check writers don't deserved to be raped and
brutalised, and
such punishments don't fit this crime at all.

 Of course, some people wind up in the system even through they are
truly
innocent. Also, it's possible to get raped in jail before going to
trial.
