These matters are covered by the FCC, which must act under the rules of
the International Telecommunications Union (ITU). Under ITU regulations,
ALL RADIO TRANSMITTERS (with the exception of small units, like cel
phones, toy walkie-talkies, etc) MUST BE LICENSED.
The reason it is so hard to set up a broadcast station is the cost of
the engineering studies for the transmitter/antenna site (required by
ITU regs) as well as the transmitter unit itself, which has to be
EXTREMELY frequency-stable, as well as having virtually NO spurious
emissions and/or harmonics. Very few of these low-power "pirate"
transmitters are safe to use, without risk to licensed comercial
stations, not to mention public service systems- fire, EMT, etc.
