Your logic - it is ok to kill Tom, because he did something really
really bad (say he murdered his wife)

The murderer uses your logic - it is ok for me to kill Bob because he
did something really, really bad.

Better would be - it is not ok to kill folks, period.

The death penalty confirms that it is morally acceptable to kill folks
- if they are really really bad.

That's the problem.
