Taking big risks is fairly punished.

If I shoot at you and miss, I can fairly be punished.

The reason is that we want to prevent harm, and punishing acts with a
high probability of producing harm will in fact prevent harm.

You have confused probablility and outcome with the idea of a
victimless crime.
