Wasn't Bernard Goetz charged with some variant of 'illegal firearm' even
though it was obvious that he had been prudent to have it along when
attacked?

John Jay, Samuel Chase, Holmes and Harlan Stone disagree- and US v.
Dougherty, 473 F 2nd 1113, 1139, (1972) would seem to reinforce them- if my
casual layman's untutored eye is not mistaken.
