The concept of EEO is meant to deal conditions that are outside one's control but may have societal prejudices, and do not affect one's ability to do the job, of which having a Ph.D. is neither (although it may qualify for the societal prejudices part ;-) ). Other than those points, I like your idea, but perhaps it should be pushed farther: make it a legal definition that anyone with a Ph.D. is better qualified than anyone without one. It can't be any old English Lit Ph.D. either, but has to be in something like stellar astrophysics! :-) Let's have stellar astrophysicists as CEOs of all these big corporations, making the big bucks they deserve while those Havard MBA types have to take the burger flipping jobs!
