A while ago, while returning from a luncheon in Cupertino, CA, I was stopped by a police offer and ticketed for skating in a bike lane. Specifically, the infraction is VC 21966 " Pedestrian in Bicycle Lane 21966. No pedestrian shall proceed along a bicycle path or lane where there is an adjacent adequate pedestrian facility. Added Ch. 751, Stats. 1976. Effective January 1, 1977. " Preliminary research suggests that the ticket is worth fighting and that the case is winnable. My first inclination is to attack the "adequate pedestrian facility clause". The first section of the sidewalk in question is rather narrow and downhill. I was going about 17mph when the officer first flashed his lights. The second section contains areas where the concrete is actually missing. I would like to hear other thoughts on how to handle this. Preferably, I would like to hear from people who have actually fought a similar ticket in California. What worked? What didn't? -- Use the From: header.
