Well, it's kind of a touchy call because he may claim that you turned into him, taking time and distance into account. If you can make your cut in such a way that you don't go directly into him, that solves the problems. I lot of people will naturally put their arms up in anticipation of contact, so it may not be an intentional thing. Also changing direction again once there has been contact can be effective (you fake back, he fouls you, you turn around and come back in hard).
