Its a group 15 metaloid. Not a true metallic element, but it sits on the Boron, Silicon, Arsenic, Tellurium diagonal, elements on either side have both metallic and non-metallic properties. It has a fair electrically conductivity for example.
My college chemistry texts list it as a "nonmetal". Can't get much clearer than that. Even carbon is conductive under some circumstances.
It is usually classified as a heavy metal, especially by the EPA, "inorganic arsenic" which for some reason includes paris green is quoted as such in many of their documents.
Oh, for pete's sake - EPA is a POLITICAL organization, NOT a scientific one. They're about the LAST ones I would look to for objective, factual chemistry...
