Now it doesn't care, when you go to make the copy, what the CMC of the card is - if you manage to get a Spelljack imprinted on the Scepter (possible only by having it not be a Scepter originally), you can make a copy of that and play it. But if a nonInstant is imprinted on the Scepter (say it was a Duplicant-Volrath's_Shapeshifter on coming into play [yes, that means the triggered Imprint ability of the Duplicant would trigger] and got a creature card imprinted) the Scepter's ability can't make a copy of it.
