I was involved with an insurance scam and had to appear in court. The jerk tried to make the judge believe his passenger was injured and had to be taken to the hospital while he had not a scratch on him. Funny thing is, his passenger was skipping school and the officer when arriving on the scene asked right off, "Is anyone injured?". The answer was no. If police are called to the scene, make sure you get names so they can be in court to testify what they observed. Get names of all passengers. If you observe none, note it that way. Also note the conditions of the passengers. If an ambulance is called, get the name of the company and the attendants. When using a camera, get as much as the surrounding area as possible, not just the crash scene. In your case with injured passenger, the driver would have to produce the name of the passenger to the insurance company and if a claim is filed in that respect, take it to court. Make the injured person appear and testify.
