A work gains United States copyright protection automatically when it
is first fixed in a medium of expression.  A copyright notice is not
required, nor is copyright registration.  It is highly unlikely that
the application is not protected by copyright.

A trademark does not need either state or federal registration, simply
that it be used in commerce.
