Re: 12-month pendency period of the provisional application



You must file a nonprovisional application that claims the benefit of the
provisional application, filed 12/3/02, on or before 12/3/03.  Remember that
your nonprovisional application must have at least one claim.  You may use
Express Mail, post office to addressee, clearly stamped with the date.  If
you post your express mail on 12/3/03, and meet the other requirements as
set forth in the MPEP you will be accorded the filing date as the same date
that you deposited your application with the USPS.

Remember - you must follow the instructions in the MPEP to the letter.  If
you don't know what I am talking about see a patent attorney or agent.
