If you think a lawsuit will be completed before winter, you are
dreaming.  Maybe a small claims within a few months but a regular suit
will take years.

Best leeson to others: never go in debt "to the hilt" just to get the
house.  Because if you do, and anything goes wrong, you are screwed
and desperately contemplate lawsuits just to get through winter.
