Try again!  You got that basically wrong!  Most (almost all)
restrictions were essentially preempted by the FCC years ago!


You are partially right. I do remember now that there was a ruling that a HOA could not prohibit DSS dishes, but it was unclear if it went much further in scope than that. A HOA cannot prevent you from putting up TV antennas, but they can restrict the size, height, and type. Most will let you do DSS type dishes, but larger dishes (C band) may be problematic, and the rules give little protection to hams that want to put up larger antennas. They can also restrict antennas on the grounds of safety (what if it falls in a neighbors yard), particularly in townhouse developments.

(slightly OT) The universal transition to HDTV in a few years will likely pressure many of these associations to let up on their restrictions concerning antennas, as poor HDTV signals are less watchable than poor analog signals today. Rather than the random noise you see as snow, degraded HDTV signals tend to drop out, or display as pixellation, but that is another thread for another newsgroup.

A link to the relevant ruling would be helpful to the NG as well. I see many new developments around here in Central MD, but very few TV antennas in them. I may scout it and report back.
