John, when you have joined your HOA you have elected to abide by the socialistic
rules.
Is it abnormal to you to see Fidel Castro in charge of Cuba without any election
being held?
No!
So why are you asking such stupid question if it is legal or not when someone
takes over your board?.
The entire HOA concept is unconstitutional.
So enjoy your socialistic living in the USA.
