I think a  municipality is less likely to behave as if they have a personal
vendetta against you. All it takes is to be just a little impolite to one
HOA board member and they can have a hidden agenda against you. Also, one
expects to have to conform to rules from our local government. But one
doesn't always expect the crap that comes from a HOA and the amount of power
they have to enforce it.
