If the OP is still interested in cooperating with the HOA, then there's no reason to escalate it to lawyer involvement. But if the OP wishes to make the case that the HOA is bound not to enforce the CC&Rs against him, say because they have not enforced against other homeowners with similar fences, then you're right, he needs professional assistance. -- Chris Green
