Parents should definitely be looking out for their children who play on the streets of a gated community. Our private streets are common area as well. As president of our association, I believe the children should be allowed to play in a "reasonable" manner. I'll bet you love that.....so many interpretations. Our kids are pretty well watched by their parents. I, personally, drive thru the complex and yell out the window for kids on bikes over the age of 8 to watch out & be careful - they are less supervised than the little ones. I tell "kids" at the age of 13 and up (we had some 17 year olds), playing in the street - "Unless you are 5 years old & playing wiffle ball - take it to the park". These semi-adults are way too old, to be tossing a soft ball along the length of the street. They could hurt somebody, because they are old enough to do some damage - even with a soft ball. I think this is a matter of common sense. And the decision of the board, or again, the matter of communal common sense. And just like out pet with leash requirement, if there were small unsupervised children in the street, it becomes not only an issue of insurance liability - but where's the parent? If we saw a child outside without an adult in sight, the homeowner/parent would be getting a knock on their door from the board, for starters. I hope this helps.
