So, to speak slowly: 1) Art. 1, Sec. 1 gives Congress the power to pass bills. 2) Art. 1, Sec. 8 gives Congress power over the militia. 3) Using it's Constitutional imprimatur under Art. 1, Sec. 1, Congress created the National Guard by passing the Dick Act in 1903. It's not written out for you in the Constitution. It evolved over time. It was apparent that the militia system was not working very well and something else was needed. So Congress, by constitutional means, mind you, created the National Guard. That's where it comes from. There is no 'civilian militia.' Nor is there a 'citizen's militia' or whatever you want to call it. They don't volunteer in a crisis and they don't maintain a 'balance between the sovereign rights of the people and the state,' as you claim. Your entire idea of a 'civilian militia' comes from a dodge that's around 170 years old. In fact, they don't do ANYTHING except spread the paranoic belief that the government is coming to get them and that they don't have to obey a law they don't like. I help people all the time. I will bet a lot of people on this newsgroup do the same; we just don't organize a private army when we do it. What you are really talking about is new and improved freikorps like the Kentucky State 'Militia,' and they are pretty damned useless. S. Olson
